These Terms of Service ("Terms") govern your use of the website at nevergotovoicemail.com and the services provided by Northridge Support LLC, operating under the brand Never Go To Voicemail ("we," "us," or "our"). By using our website or purchasing our services, you agree to these Terms. If you do not agree, do not use our services.
1. Services
Never Go To Voicemail provides AI-powered voice agent services that answer missed calls, collect lead information, book appointments, and send notifications on behalf of small businesses ("Clients"). Services are provided on a month-to-month basis. No long-term commitment is required.
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice to active Clients.
2. Setup & Onboarding
A one-time setup fee is required prior to activation. This fee covers agent configuration, script writing, knowledge base training, calendar integration, and go-live testing. The setup fee is non-refundable once onboarding work has begun.
3. Billing & Payment
Monthly subscription fees are billed in advance on a recurring basis. Payment is due on the same date each month following activation. We accept major credit and debit cards processed through our third-party payment processor.
If a payment fails, we will notify you and attempt to collect payment. Services may be suspended after 7 days of non-payment. You are responsible for keeping your billing information current.
Usage overages — calls or minutes exceeding your plan's included allowance — will be billed at the applicable overage rate disclosed at the time of signup.
4. Cancellation
Either party may cancel the service with 7 days written notice sent to hello@nevergotovoicemail.com. Cancellation takes effect at the end of the 7-day notice period. No partial-month refunds are issued unless otherwise agreed in writing.
We reserve the right to terminate service immediately if a Client violates these Terms, engages in unlawful activity, or uses our service in a way that harms third parties.
5. Uptime & Service Level
We target 99.9% monthly uptime for the AI voice agent service. Uptime is measured as the percentage of time the service is operational and able to receive and handle calls during a given calendar month.
If uptime falls below 99.9% in any calendar month due to causes within our reasonable control, you are eligible to receive a pro-rated credit applied to your next billing cycle. The credit will be calculated based on the number of hours of verified downtime relative to your monthly fee.
Uptime credits are your sole remedy for service interruptions. Credits do not apply to downtime caused by: scheduled maintenance (with advance notice), third-party platform outages (including GoHighLevel, carrier networks, or phone infrastructure), your own misconfiguration or failure to maintain call forwarding, or events outside our reasonable control including natural disasters, cyberattacks, or government actions.
To request a credit, contact us within 14 days of the affected billing period with a description of the outage.
6. Client Responsibilities
You are responsible for: maintaining accurate call forwarding settings on your phone number; providing accurate business information during onboarding; ensuring the information you provide us does not violate any third-party rights; and complying with all applicable laws in your use of the service, including telemarketing and consumer protection regulations.
You must not use our service to conduct fraudulent, deceptive, or illegal activity, or to harass callers.
7. Call Recordings & Data
Calls handled by your AI agent may be recorded for quality assurance and service improvement. By using our service, you confirm that you have obtained or will obtain any required consent from callers as required by applicable law in your jurisdiction. You are solely responsible for compliance with call recording consent laws (such as two-party consent states) in your area.
Call data, recordings, and lead information collected through your agent are your business data. We process this data on your behalf and do not use it for any purpose other than delivering your service.
8. Intellectual Property
All website content, branding, agent scripts developed by us, and proprietary systems remain the intellectual property of Northridge Support LLC. You may not copy, reproduce, or distribute our materials without written permission.
You retain ownership of all business information, customer data, and content you provide to us for agent training.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total fees you paid to us in the three months preceding the claim.
We are not liable for: lost revenue or profits resulting from missed calls; decisions made by callers after interacting with your AI agent; errors in information provided to callers based on inaccurate data you supplied; or any indirect, incidental, consequential, or punitive damages.
10. Disclaimer of Warranties
Except for the uptime guarantee described in Section 5, our services are provided "as is" and "as available." We make no representations that the service will be error-free, that all calls will be handled perfectly, or that the service will meet every specific business requirement. AI voice agents may occasionally misunderstand callers or provide incomplete responses — this is inherent to the technology.
11. Indemnification
You agree to indemnify and hold harmless Northridge Support LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your failure to comply with applicable laws including call recording consent requirements.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Wake County, North Carolina.
13. Changes to These Terms
We may update these Terms from time to time. We will notify active Clients of material changes via email at least 7 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
